CHAPTER 7 BANKRUPTCY
A Chapter 7 Bankruptcy provides you a fresh start by wiping out or “discharging” your allowable debts. Whether you should file a Chapter 7 bankruptcy will depend upon your circumstances. Your attorney will want to examine your debts, your assets, and your income, among other things, before you file. A Trustee is appointed to take over your “non-exempt” property for the creditors, but most Chapter 7 debtors can keep most of their important property under the bankruptcy laws. Bankruptcy is NOT right for every situation and your specific case will depend on your own circumstances.
Our Chapter 7 Legal Fee is generally between $500-$700 depending on your case. The court charges an additional court filing fee of $209. The most typical fee is $500 + $209 Court fee. We always try to keep our fees as reasonable and competitive as possible.
CHAPTER 13 BANKRUPTCY
This type of bankruptcy allows you to repay your debts over time in a “Plan” and usually keep your property. Most commonly, debtors will file this type of bankruptcy to stop a foreclosure proceeding and repay mortgage arrearages. The Court will examine your budget and must approve your “Plan”.
Our Chapter 13 Bankruptcy Fee is approximately $1000, depending on your case. The additional court filing fee is $194. We always try to keep our fees as reasonable and competitive as possible.
